Governor Jeb Bush 400 S. Monroe Street RE: IMPROPRIETIES REGARDING THE PALM BEACH COUNTY STATE ATTORNEY’S OFFICE IN THE CASE OF:STATE OF FLORIDA VS. Mr. M CASE # XXXXXXXXXX Dear Governor Bush, I am writing to you in regards to the above referenced case. We have come to learn that Mr. M. was arrested at his home located in Boca Raton on February 25, 2004. According to the City of Boca Raton Police Report, Mr. M. was arrested for possession of crack cocaine and paraphernalia after a report was made to DCF alleging that Mr. M. was doing cocaine in front of his nine year old daughter, and allegedly having prostitutes over his house with the same nine year old present. (TAB A). While out on bond, Mr. M. is arrested again on March 13, 2004 when the police received a report that a vehicle was driving recklessly. In the vehicle the police found 1.5 grams of crack cocaine “in plain view” on the console of his car and a crack pipe in plain view. (TAB B). Mr. M. posted bond on the following day. Arraignment was set for March 26th on the first case and then postponed. On Monday March 28, 2004, I became aware through court files that the P.B.SAO decided on a “No File” in the 2nd arrest where 1.5 grams of crack cocaine was found “in plain view”. The reason given in the “No File” was: “Based on lack of evidence to prove beyond a reasonable doubt that the defendant either knew of the cocaine or exercised dominion and control over it. Therefore, prosecution is not warranted”. (TAB C). Any reasonable person would have to question what went on here. I immediately alerted the WPEC NEWS 12, WFLX FOX 29 and The Boca Raton News. (TAB D) I also wish to remind you that Mr. M. is the husband of my former wife, who killed my daughter while she was high on cocaine in February of 2000 and originally received probation. That was the case, which I re-investigated, sent my findings to your office and you forwarded on to the FDLE in 2002: FDLE File EI-73-4555-68/67 FDLE File EI-73-4555-192/67 Why does it appear this affluent family is getting special treatment?
